Probate is a legal process that is required after a person dies if their assets are of a certain value, currently €25,000 and despite what some people believe. Probate is still required where there is a valid will in place . It involves an application to the Probate Office for a Grant of Representation which then allows the personal representative to gather in and distribute the deceased's assets in accordance with the terms of the Will or the rules of Intestacy if the deceased did not leave a will.
How long it will take for the Grant of Representation to issue from the Probate Office depends on the size and complexity of the deceased's estate.
There is a considerable amount of paperwork to complete before you can apply for Probate. Sometimes, this will be relatively straightforward. Other times, with more complex matters it will take many months to fulfil.
Most of the work is centred on identifying the deceased's assets and liabilities and completing the Inland Revenue Affidavit.
